General Terms and Conditions

Article 1 – Definitions

In these terms and conditions, the following definitions apply:

• Cooling-off period: The period during which the consumer can exercise their right of withdrawal.
• Consumer: The natural person who does not act in the exercise of a profession or business and enters into a distance contract with Novessa.
• Day: Calendar day.
• Continuous transaction: A distance contract relating to a series of products and/or services, for which the delivery and/or purchase obligation is spread over time.
• Durable data carrier: Any means that allows the consumer or Novessa to store information addressed to them personally in a way that enables future consultation and unchanged reproduction of the stored information.
• Right of withdrawal: The possibility for the consumer to withdraw from the distance contract within the cooling-off period.
• Novessa: The legal entity offering products and/or services remotely to consumers.
• Distance contract: A contract concluded within the framework of an organized system for distance selling of products and/or services, where only one or more means of distance communication are used up to and including the conclusion of the contract.
• Means of distance communication: A method that can be used to conclude a contract without the consumer and Novessa being physically present in the same place at the same time.
• General Terms and Conditions: These General Terms and Conditions of Novessa.

Article 3 – Applicability

These general terms and conditions apply to every offer made by Novessa and to every distance contract concluded between Novessa and the consumer.

Before concluding a distance contract, the text of these general terms and conditions will be made available to the consumer. If this is not reasonably possible, it will be indicated before the contract is concluded that the terms and conditions are available for review and will be sent free of charge upon request.

Article 4 – The Offer

• If an offer has a limited validity period or is subject to conditions, this will be explicitly stated in the offer.
• The offer is non-binding. Novessa is entitled to modify and adjust the offer.
• The offer contains a complete and accurate description of the offered products and/or services.

Article 5 – The Agreement

• The contract is established when the consumer accepts the offer and meets the stipulated conditions.
• If the consumer has accepted the offer electronically, Novessa will confirm receipt of the acceptance immediately by electronic means.
• Novessa may investigate whether the consumer can fulfill their payment obligations and refuse an order if there are justified reasons.

Article 6 – Right of Withdrawal

• The consumer has the right to withdraw from the contract within 14 days from the day of receipt of the product.
• The consumer must notify Novessa of their wish to withdraw via email ( info@novessa-londen-uk.com) within this period.
• After the withdrawal request, the consumer has another 14 days to return the product.

Article 7 – Costs and Process of Withdrawal

• If the consumer exercises their right of withdrawal, they are responsible for the return shipping costs (€8 - €12).
• The return shipment must always be sent with Track & Trace, as Novessa is not responsible for lost returns.
• If the product is damaged upon arrival and cannot be used, the consumer must provide photos or videos within 48 hours. After verification, Novessa will offer a replacement or refund.
• If a product is returned because the consumer simply does not like it, Novessa will first try to find a solution together before proceeding with a return due to high shipping costs.

• Refunds will be processed within 14 business days after Novessa receives the returned product.

Article 8 – Exclusion of Right of Withdrawal

• The right of withdrawal does not apply to custom-made products, perishable goods, or hygiene-related products if the seal has been broken.

Article 9 – Prices

• The prices of the offered products and/or services will not increase during the validity period of the offer, except for price changes due to VAT adjustments.

Article 10 – Warranty & Complaints

• Products must meet the contract, specifications, and reasonable usability.
• If a product has defects, they must be reported within 14 days of receipt.
• Complaints must be submitted within 7 days of discovering the defect and will be responded to within 14 days.

Article 11 – Delivery and Execution

• Novessa will take the utmost care in receiving and executing product orders.
• The delivery address is the one provided by the consumer.
• If delivery is delayed, the consumer will be informed within 30 days and has the right to cancel the contract.

Article 12 – Payment

• Payments must be made within 7 business days, unless otherwise agreed.

Article 13 – Disputes

• Agreements between Novessa and the consumer are exclusively governed by Dutch law, even if the consumer resides abroad.
